Terms and Conditions of Sale

By placing an order with Weekend Wine LLC ("Weekend Wine," "we," "us," or "our"), you acknowledge that you have read and agree to these Terms & Conditions, including the shipping, insurance, storage, delivery, and return provisions below.

These Terms apply to purchases made through Weekend Wine's website and to orders placed directly with our team where these Terms are provided and accepted.

1. Age and Legal Eligibility

You must be at least 21 years of age to purchase alcoholic beverages from Weekend Wine.

By purchasing, you represent that you are legally eligible to purchase and receive the products ordered and that the transaction complies with applicable laws.

All deliveries require acceptance by an adult age 21 or older, with identification and signature as required by the carrier.

Weekend Wine reserves the right to refuse or cancel orders that cannot lawfully be fulfilled.

2. Shipping Arrangements and Carrier Services

Weekend Wine arranges transportation through third-party carriers and logistics providers, including UPS and FedEx.

At the customer's request, Weekend Wine may coordinate transportation on the customer's behalf, including shipping dates, service levels, and delivery instructions.

Once a shipment has been accepted by the carrier, transportation and delivery are subject to the carrier's operations, policies, and service limitations.

Estimated transit times are not guaranteed unless expressly confirmed otherwise in writing.

Weekend Wine will make reasonable efforts to assist customers with delayed, missing, damaged, or misrouted shipments.

3. Transfer of Risk and Carrier Liability

To the fullest extent permitted by applicable law, and where the transaction constitutes a shipment contract rather than a destination-delivery contract, risk of accidental loss or damage transfers to the customer when the wine is properly tendered to the designated carrier.

After risk has transferred, Weekend Wine is not responsible for losses arising solely from carrier mishandling, misrouting, theft, accidental damage, or transportation delays, except where required by law or resulting from Weekend Wine's own failure to fulfill its obligations.

Customers acknowledge that third-party carriers operate independently of Weekend Wine and that carrier tracking, handling, and delivery outcomes are not entirely within our control.

Nothing in these Terms limits any rights or remedies that cannot legally be waived.

4. Optional Shipping Insurance

Shipping insurance is optional and is not automatically included with purchases or standard shipping charges.

Customers wishing to obtain shipping insurance must contact Weekend Wine before shipment to request coverage and receive a quotation.

Coverage must be expressly confirmed and any applicable premium paid before the shipment is tendered to the carrier.

Shipping insurance may provide protection against qualifying loss or physical damage during transportation, subject to the insurer's terms, limits, conditions, and exclusions.

Unless expressly included in a particular policy, insurance does not cover:

• Heat or cold exposure

• Cork taint or inherent wine defects

• Ordinary deterioration or changes in wine quality

• Excluded events or losses under the applicable policy

Customers who decline or do not request shipping insurance acknowledge that their shipment may not be protected against its full value in the event of carrier loss or damage.

Any carrier liability that may apply is separate from optional insurance and is governed by the applicable carrier agreement and law. Carrier reimbursement is not guaranteed.

5. Weather-Related Shipping Risks

Fine wine is sensitive to temperature extremes and prolonged exposure to heat or freezing conditions.

Weekend Wine recommends shipping during moderate weather and offers complimentary seasonal storage to help protect purchases.

Customers who request shipment during potentially unsafe weather conditions acknowledge the possibility of temperature-related damage, including during transportation, sorting, temporary storage, and delivery.

When a customer elects to proceed against Weekend Wine's documented weather-related recommendation, the customer assumes the associated temperature-exposure risk to the extent permitted by law.

Weekend Wine is not responsible for temperature-related damage resulting from such an election, except where otherwise required by law.

Protective packaging reduces certain transportation risks but does not guarantee temperature control.

6. Delivery, Tracking, and Customer Responsibilities

Once tracking information has been provided, customers are responsible for monitoring shipment progress and making reasonable arrangements to receive delivery.

Customers must ensure that an adult age 21 or older is available to accept the shipment.

Customers are responsible for providing accurate delivery information and promptly notifying Weekend Wine of any necessary corrections.

Refused, undeliverable, unclaimed, or returned shipments may incur additional transportation, handling, or storage charges.

Where a shipment is delivered to a carrier-approved Hold at Location facility, customers are responsible for collecting it within the carrier's designated pickup period.

Carrier delivery scans, signatures, and pickup records may be used as evidence of delivery but do not override applicable legal rights.

7. Shipping Delays, Missing Packages, and Claims

Carrier delays, missed delivery estimates, routing exceptions, and temporary tracking interruptions do not automatically entitle a customer to a refund.

If a shipment is delayed, missing, or damaged, customers should notify Weekend Wine promptly so we can assist with carrier investigations or available claims procedures.

Weekend Wine may coordinate with the carrier or logistics provider to investigate the shipment, but cannot guarantee recovery, a particular delivery date, or reimbursement from the carrier.

Refunds, replacements, and other remedies for lost or undelivered shipments will be determined in accordance with these Terms, the applicable allocation of risk, and governing law.

Where insurance was purchased, eligible claims are subject to the insurance policy's coverage terms.

8. Returns, Cancellations, and Final Sales

Orders may generally be canceled before shipment, subject to a 3% cancellation fee intended to recover applicable non-refundable processing costs, where permitted by law and disclosed before purchase.

Once an order has shipped, cancellations and returns are generally not accepted, except where required by law or expressly approved by Weekend Wine.

All sales become final 30 days after purchase, subject to any rights or remedies that cannot legally be excluded.

Returns or refunds are generally not available solely because:

• The customer no longer wants the wine

• The wine was purchased as a gift

• The customer dislikes the wine's taste

• The wine has cork taint or other inherent bottle variation

• A carrier experiences an ordinary transportation delay

• The customer elects shipment against documented weather recommendations

Wines more than 10 years old and international shipments are generally final sale due to their age, fragility, and transportation sensitivity, subject to applicable law.

9. Incorrect or Damaged Orders

Weekend Wine takes care to verify the identity and condition of bottles before shipment.

If you receive the wrong wine, vintage, or quantity, please contact us promptly.

For visible breakage, leakage, or shipping damage, customers should photograph the affected bottles and packaging and notify david@weekendwine.com preferably within 24 hours of delivery.

Prompt reporting helps us investigate and pursue carrier claims. Failure to report within 24 hours does not eliminate rights that cannot legally be waived.

We will review reported issues individually and provide appropriate remedies where required.

10. Complimentary Wine Storage

Weekend Wine offers complimentary cellar storage for up to 12 months from the date of purchase.

Wine is stored at our professionally managed facility operated in partnership with UOVO at:

The facility is maintained at approximately 55°F with controlled humidity and environmental monitoring.

Weekend Wine will make reasonable efforts to contact customers before the complimentary storage period ends to coordinate delivery.

Storage beyond 12 months requires separate arrangements. Any applicable charges or conditions will be disclosed before they take effect.

11. Shipping Laws and Regulatory Compliance

Alcohol transportation is subject to federal, state, local, and international regulations, as well as carrier-specific requirements.

Customers represent that they are legally eligible to purchase and receive the products ordered and agree to provide accurate information necessary to verify eligibility.

Weekend Wine reserves the right to decline, delay, or cancel shipments where fulfillment would violate applicable law or carrier requirements.

Customers are responsible for applicable duties, import charges, and other taxes or governmental assessments legally payable by them.

Weekend Wine remains responsible for its own licensing, compliance, tax collection, and other non-delegable legal obligations.

Where an order is seized, returned, or cannot be delivered due to a regulatory or carrier restriction, refund eligibility and allocation of related expenses will be determined under applicable law and the circumstances of the transaction.

12. International Shipments

International orders may be subject to additional customs requirements, duties, tariffs, taxes, delays, and import restrictions.

International shipping quotations generally exclude duties and taxes unless expressly stated otherwise.

International sales are generally final, except where applicable law requires a refund or other remedy.

Weekend Wine cannot guarantee customs clearance or international delivery timelines.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Weekend Wine is not liable for indirect, incidental, special, or consequential damages arising from carrier delays, shipment interruptions, or transportation-related events outside its reasonable control.

Nothing in these Terms excludes liability for fraud, willful misconduct, or other liability that cannot legally be limited.

Any limitations of liability apply only to the extent enforceable under the laws governing the transaction.

14. Policy Acceptance and Updates

By selecting the required acknowledgment checkbox at checkout and completing your purchase, you confirm that you have had an opportunity to review and accept these Terms.

Weekend Wine may update these Terms periodically. Changes will apply prospectively to orders placed after the updated Terms become effective, unless otherwise permitted by law.

The version of the Terms presented and accepted at the time of purchase governs that transaction, subject to applicable law.
